Terms of Service — Mo'chefe

1. Acceptance of these Terms

By creating an account, installing the Mo'chefe application, or continuing to use it, you confirm that you have read, understood, and accepted these Terms and the Privacy Policy. If you do not agree with any part of these Terms, please do not use the application.

These Terms form a contract between you and Mo'chefe — a trading name; the registered legal entity in Angola is being formed. "Mo'chefe", "we", and "our" refer to the entity providing the service; "you" refers to the person accepting these Terms.


2. What Mo'chefe is

Mo'chefe is an application for managing households and domestic staff in Angola: attendance, tasks, schedule, payroll, pantry, and meals. Mo'chefe replaces informal coordination via WhatsApp, phone calls, and paper with a structured system.


3. Who can use Mo'chefe

Mo'chefe is for adults (18 or older).

These Terms use three distinct terms, even though, in most MVP-stage households, all three refer to the same person:

There are two account types:

For the Subscriber. When you create your account, you confirm that (a) you are 18 or older, (b) you have the legal right to employ (or to act on behalf of those who employ) domestic staff in the households you register, and (c) the workers you add to the application have been informed in advance and consent.

For the domestic worker. By using the app on your phone you accept that the household that employs you uses Mo'chefe to record your attendance, calculate your pay, and coordinate your tasks, as described in the Privacy Policy.


4. The Employer's obligations to the worker

As a domestic-work employer in Angola, the Employer retains in full its obligations under Lei 12/23 (the General Labour Law) and Decreto Presidencial 155/16 (the legal regime for domestic work) — in particular, written contract, work booklet, social-security contributions, minimum wage, observance of working hours, and other worker rights. Mo'chefe is a coordination tool that can help organise some of these obligations, but does not replace fulfilling them nor guarantee their compliance.

The Employer represents and warrants that, before adding any person to the application as a domestic worker, it informed that person that the household uses Mo'chefe to record attendance, calculate pay, and coordinate tasks, and obtained their consent for this use. When the household chooses to activate additional features — for example, phone-biometric verification — the Employer will obtain the worker's specific consent for that feature, without making the continuation of the employment relationship depend on that consent.

5.A Multi-party arrangements

Where the Subscriber, the Employer, and the Household are not the same party, the Subscriber represents and warrants that it has the necessary authority from each Employer to register that Employer's workers in Mo'chefe, and shall indemnify Mo'chefe for any failure to do so.

7. Intellectual property

The Mo'chefe application, including code, design, logos, trademarks, written content, and icons, is owned by Mo'chefe and protected by Angolan and international copyright and trademark law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the application in compliance with these Terms.

Your data is yours. The data you enter into the application — employee names, household address, attendance records — remains yours (or the worker's, as applicable). Mo'chefe has only a limited licence to process that data to provide the service, as described in the Privacy Policy.


8. Payments

When Mo'chefe begins offering paid plans, we will communicate, with reasonable notice, the prices, conditions, and the option to continue — or not — using the application under the new terms. Nothing in these Terms currently creates any payment obligation on your part.


9. Termination

The Subscriber may terminate the use of Mo'chefe at any time, without giving a reason and at no cost, by closing the account in the application settings or emailing legal@mochefe.com. After closure, data is handled as described in the Privacy Policy.

Termination of the subscription ends the contractual relationship between the Subscriber and Mo'chefe; it does not, in itself, end the employment relationship between the Employer and the worker, which remains subject to Lei 12/23 and Decreto Presidencial 155/16.

Mo'chefe may terminate or suspend an account if (a) these Terms are materially breached, (b) the app is used for unlawful purposes or harm to third parties, (c) materially false information is provided, or (d) where required for Mo'chefe to comply with a legal order or protect other users. We will give prior notice where possible.


10. Limitation of liability

The Mo'chefe application is provided "as is" and "as available", without warranties of fitness for a specific purpose, uninterrupted operation, freedom from errors, or absolute calculation accuracy. Mo'chefe does not replace human verification — payroll calculations, attendance records, and reminders should be reviewed by the Employer before any payment or employment decision.

To the maximum extent permitted by Angolan law, Mo'chefe is not liable for:

Nothing in these Terms limits Mo'chefe's liability where Angolan law does not allow such limitation — in particular, in cases of wilful misconduct, gross negligence, harm to the worker's personality rights, or breach of personal-data-protection rights.


11. Governing law and jurisdiction

These Terms are governed by Angolan law. Any dispute arising from the interpretation or performance of these Terms is submitted to the exclusive jurisdiction of the courts of Luanda, without prejudice to consumer-law provisions that may grant jurisdiction to the consumer's domicile court.


12. Updates to these Terms

Mo'chefe may update these Terms as the application evolves. The date at the top of the document shows when they were last updated. If the change is material, we will notify you by email and in-app before the new version takes effect — continued use after that date means acceptance of the new Terms.


13. Miscellaneous

These Terms, together with the Privacy Policy, form the entire agreement between you and Mo'chefe regarding the use of the application. If any clause of these Terms is found invalid or unenforceable, the remaining clauses remain in force. Failure to enforce any clause at one time does not waive the right to enforce it later. You may not assign your rights or obligations under these Terms to third parties without our written consent; Mo'chefe may assign its rights and obligations to a successor entity, with notice to you.
